BIFA – COVID-19 Update

It was the best of times, it was the worst of times.

We are currently living in unprecedented times, with Stage 1 and Stage 2 closures of certain non-essential businesses, which includes where people congregate, especially inside or in close proximity outside to limit the spread of the coronavirus (COVID-19).  However, the Prime Minister has stressed that all other jobs are essential and that includes those businesses and sole traders working in building, construction and infrastructure industry. Therefore, it is important to remember that the Building Industry Fairness (Security of Payments) Act 2017 (Qld) (BIFA) remain in effect because, as important as it is to continue to work , continuing to get paid is just as essential!

The Queensland Government has not taken any steps to extend or suspend the relevant BIFA timeframes at this stage.  The Queensland Building and Construction Commission’s (QBCC) offices are still open and the QBCC is accepting adjudication applications at their offices (with appropriate social distancing and safety precautions in place) and online.  If you do chose to lodge your adjudication applications online, the (rather small) file size limits still apply.
